Can registration cease?

A training organisation's registration may cease if:

  • The period of registration expires;
  • The Registered Training Organisation (RTO) wishes to cease its operation; 
  • There are grounds for de-registration due to non compliance with the AQTF Essential Standards for Registration; or
  • The business is sold.

If an RTO's registration ceases, it will no longer be able to promote itself as being registered and must forward to the TAC Secretariat all students records or negotiate with the TAC Secretariat other arrangements for the transfer of these records.

 

When does registration expire?

If an RTO does not renew its registration before the five year registration period expires, its RTO status will cease. The RTO must send the Training Accreditation Council Secretariat an electronic copy and hard copy of all student results, detailing Qualifications/Statements of Attainment granted and a list of competencies achieved by each student.

 

What if I want to cease operation?

An RTO can apply to the Council to cancel its registration by completing a RTO6 Notification of Voluntary Relinquishment form. The Council requires RTOs who cease operation to ensure that all continuing students are catered for and not disadvantaged. The RTO must send the TAC Secretariat a copy of the student results, including awards/Statements of Attainment and a list of competencies achieved by individuals.

 

How could an RTO be de-registered?

Where an RTO has outstanding non compliance with the AQTF Essential Standards for Registration and these have not been resolved in accordance with the Council's approved policy, the RTO may be notified by the Council that it has entered the de-registration process.

The following would be grounds for de-registration of an RTO:

  • failure to comply with the AQTF Essential Standards for Registration or submit to a monitoring audit for that purpose;
  • where registration has been obtained by fraud;
  • if the owner of the RTO has been convicted of an offence that renders that person inappropriate to carry on the business of a training provider; or
  • persons who manage or control the RTO are not fit and proper persons.

In the event that a complaint or monitoring audit indicates that the RTO is not complying with the AQTF Essential Standards for Registration:

  • the Council will notify the RTO in writing, requesting action to become compliant;
  • a date will be set for review to assess whether the RTO now meets the standards;
  • if the review indicates that the RTO has not become compliant, it will be again notified by the Council in writing and given 21 days to respond; and
  • The RTO must respond in writing and may request a meeting with the Council to appeal after which the Council will make its final decision on whether to cancel registration.

What if my business is sold?

Registration cannot be transferred, sold or otherwise assigned to another individual, legal entity organisation. Registration is 'personal' to the legal entity that obtains it. It is not a transferable commodity or asset. A business may be bought or sold, but not the registration.
